GDPR Compliance at Fundacja Rozwoju Przedsiębiorczości „Twój StartUP”

Introduction

On May 25th, 2018, the General Data Protection Regulation (GDPR) came into force (hereinafter referred to as “the Regulation”). The Regulation introduces several changes regarding the responsibilities of companies processing personal data, aiming to expand and standardize the rights of data subjects and data security regulations across the European Union.

The controller of your personal data is Fundacja Rozwoju Przedsiębiorczości „Twój StartUP,” located in Warsaw at ul. Żurawia 6/12 lok. 766, 00-503 Warszawa, Poland. Purpose of Data Processing

  1. Fulfillment of contractual obligations.
  2. Compliance with legal requirements including but not limited to:
    • Accounting Act of September 29, 1994 (Journal of Laws from 2017, item 1858).
    • Anti-Money Laundering and Counter-Terrorism Financing Act of November 16, 2000 (Journal of Laws 2000 No. 116 item 1216).
    • Tax Ordinance Act of August 29, 1997 (Journal of Laws 1997 No. 137 item 926).
  3. Archival purposes (for evidence) to protect and assert legal claims.
  4. Consent-based processing, if consent has been granted, specifying the categories and purposes of processing.

Automated Decision Making

There will be no automated decision-making processes, including profiling, applied to your data. If this policy changes, we will notify you by email.

Data Requirements

To perform a contract, we process data provided on the contract form. Additional information may be requested but is not mandatory for the performance of the contract.

Data Sharing

  • Public authorities, if required by law.
  • Data processors acting on behalf of Fundacja, based on a data processing agreement.
  • Independent data controllers such as legal advisors, couriers, and postal services.
  • Recipients of personal data outside the EEA, if applicable.

Data Retention Period

Your personal data will be processed for the duration necessary to fulfill the services outlined, perform contracts, comply with legal obligations, protect our legal interests, and until you withdraw consent or object to the processing.

Transfer of Data outside the EEA

We do not transfer your personal data outside the EEA unless a legal basis exists. Should such a transfer be necessary, you will be fully informed of the risks and required to provide consent.

Your Rights

  • Access, rectification, erasure, restriction, portability of data.

  • Object to data processing.

Free Provision of Data

Providing personal data is necessary to perform contracts. If data is withheld, contract fulfillment may be impossible.

Change of Processing Purpose

If the purpose of data processing changes, we will inform you about the change and provide necessary details.

Right to Object

You may object to the processing of your data by contacting the Polish Data Protection Authority.
